REMEMBERING ERWIN
Erwin Joel Ocasio was a little boy whose life ended before he had the chance to experience so many of the joys of childhood. At just two years old, he deserved a home filled with warmth, patience, and protection. Instead, the people responsible for his care subjected him to unimaginable cruelty.
Erwin was more than the circumstances of his death. He was a child whose life mattered, whose suffering deserved to be recognized, and whose name deserves to be remembered.
ERWIN'S STORY
In September 2003, Erwin was living in Hartford, Connecticut, with his father, Nelson Ocasio, and his father's girlfriend, Yumarie Cruz.
According to accounts of the investigation, Erwin endured repeated physical abuse inside the home. Cruz reportedly struck him with a stick when he refused to eat and encouraged her daughters to participate in mistreating him.
One of the most disturbing accounts came from Erwin's teenage stepsister, who discovered him restrained in a car seat inside a bedroom. His sweatshirt had been placed backward over his body, with the hood pulled tightly over his face. When she looked beneath the clothing, she saw bruises on his face. Erwin was still alive, but the girl later indicated that she had been afraid to report what she witnessed because she feared punishment.
On September 23, 2003, Nelson Ocasio brought his severely injured son to Connecticut Children's Medical Center in Hartford. Erwin arrived in cardiac arrest with multiple injuries and was placed on life support.
His father claimed that he had struck Erwin's chest and back while attempting to revive him after the child vomited and became unresponsive. He also claimed that Erwin's head had accidentally struck a doorframe and the bathroom floor.
Erwin's injuries were far more serious than those explanations suggested.
Despite medical efforts to save him, Erwin was removed from life support on September 26, 2003, and pronounced dead.
The medical examiner determined that his death resulted from blunt traumatic injury to the head.
WARNING SIGNS & SYSTEM FAILURES
Erwin's death followed abuse that had already been witnessed inside his home.
His teenage stepsister's account revealed that he had been restrained, concealed beneath clothing, and visibly injured before the events that led to his hospitalization. Her fear of punishment prevented her from reporting what she had seen.
The allegations that Cruz repeatedly struck Erwin and encouraged other children to hurt him further demonstrated the dangerous environment in which he was living.
Erwin's story illustrates how fear and intimidation within a household can prevent abuse from being reported, leaving a vulnerable child without the protection he desperately needs.
JUSTICE FOR ERWIN
Following Erwin's death, his father, Nelson Ocasio, faced serious criminal charges, including murder and capital felony charges.
He ultimately pleaded guilty to first degree manslaughter and risk of injury to a child. He received a sentence that included 20 years in prison, an additional suspended 10 year term, and five years of probation.
Yumarie Cruz also faced a capital felony charge before reaching a plea agreement. She was convicted of risk of injury to a minor and hindering prosecution, with the agreement providing for a prison sentence of up to five years.
Although the criminal proceedings resulted in convictions, no sentence could restore the childhood Erwin lost or the life he should have been allowed to live.
